Scanlon (2008) has argued that his theory of permissibility (STP) has more explanatory power than the Doctrine of Double Effect (DDE). I believe this claim is wrong. Borrowing Michael Walzer’s method of inquiry, I will evaluate the explanatory virtue of these accounts by their understanding of actual moral intuitions originated in historical cases. Practically, I will evaluate these accounts as they explain cases of hostage crises. The main question in this context is: is it permissible that nation-states act with military (...) force in order to liberate hostages, even if those actions put the lives of the hostages at risk? The first part of this paper has an operative reconstruction of the relevant theories. In the second section, two cases of hostage crises will be considered: the Moscow theater hostage crisis of 2002, and the Jaque Operation, which occurred in Colombia in 2008. Additionally, it will be shown that DDE explains these cases better than STP. Finally, this paper offers a critical analysis of Scanlon’s account of the explanatory power of both STP and DDE. The rhetorical view suggests that the goal of factual ar- gumentation in legal proceedings is to persuade the fact-finder about the facts under litigation. However, R does not capture our social expecta- tions: we want fact-finders to know the facts justifying their decisions, and persuasion does not necessarily lead to knowledge. I want to present an epistemic theory of argumenta- tion honoring our expectations. Un- der my account, factual argumenta- tion aims to transmit knowledge to the fact-finder.

In this paper I propose a method to solve controversies in scenarios of legal pluralism. Shortly, in scenarios of legal pluralism some of the controversies involve members of culturally differentiated groups who justify their allegations with arguments that only make sense in the culture to which they belong. If the adjudicator does not share the same cultural worldview as the parts under litigation, how can he/she come to make a decision determining the parties’ rights and obligations? My answer for this (...) question includes (1) an account of knowledge to culturally differentiated groups, and (2) a method for the evaluation of the culturally-dependent arguments. (shrink)

The computation of both Scalar Implicatures (SI) and Association with Focus (AF) is characterized with reference to sets of alternatives. However, it has generally been assumed that the relevant alternatives are determined in different ways for the two processes. Specifically, it has been assumed that the alternatives for SI – scalar alternatives – are computed by a special procedure specifically designed for implicatures, whereas the alternatives for AF – focus alternatives – are determined by the general theory of association with (...) focus – focus semantics. As far as we know, the only attempt to connect the two is Krifka (1995), under which scalar alternatives and focus alternatives are identical and determined by focus semantics. However, Krifka’s result is based on a specific stipulation about scalar items, which he borrows from Horn and incorporates into focus semantics, namely that scalar items are inherently focused and have their Horn Scale as their lexically specified focus values. There is ample discussion of MBA self-serving values in the corporate social responsibility literature, and yet empirical studies regarding the corporate manifestations and consequences of those values are scant. In a comprehensive study of major US public corporations, we find that MBA CEOs are more apt than their non-MBA counterparts to engage in short-term strategic expedients such as positive earnings management and suppression of R&D, which in turn are followed by compromised firm market valuations.

Background: Nurses are the largest professional group in healthcare and those who make more decisions. In 2014, the Committee on Bioethics of the Council of Europe launched the “Guide on the decision-making process regarding medical treatment in end-of-life situations”, aiming at improving decision-making processes and empowering professionals in making end-of-life decisions. The Guide does not mention nurses explicitly. Objectives: To analyze the ethical principles most valued by nurses working in palliative care when making end-of-life decisions and investigate if they are (...) consistent with the framework and recommendations of the Guide; to identify what disputed/controversial issues are more frequent in these nurses’ current end-of-life care practices. Design: Qualitative secondary analysis. Participants/context: Three qualitative datasets including 32 interviews from previous studies with nurses working in palliative care in Portugal. Ethical consideration: Ethical approval was obtained from the Ethics Research Lab of the Instituto de Bioética. Ethical procedures are thoroughly described. Findings: All participant nurses referred to autonomy as an ethical principle paramount in end-of-life decision-making. They were commonly involved in end-of-life decision-making. Palliative sedation and communication were the most mentioned disputed/controversial issues. Discussion: Autonomy was highly valued in end-of-life care and decision-making. Nurses expressed major concerns in assessing patients’ preferences, wishes, and promoting advance care planning. Nurses working in palliative care in Portugal were highly involved in end-of-life decision-making. These processes embraced a collective, inclusive approach. Palliative sedation was the most mentioned disputed issue, which is aligned with previous findings. Communication also emerged as a sensitive ethical issue; it is surprising, however, that only three nurses referred to it. Conclusion: While the Guide does not explicitly mention nurses in its content, this study shows that nurses working in palliative care in Portugal are involved in these processes. Further research is needed on nurses’ involvement and practices in end-of-life decision-making. (shrink)

RESUMEN El objetivo del presente estudio está dirigido a exponer particularidades éticas del trabajo anatomopatológico a la luz de la realidad histórico social. Se emplean métodos teóricos y empíricos y a partir del análisis documental se opera con referentes en los enfoques contemporáneos. El estudio de aspectos generales referidos a la moral y a la ética permitió acceder a definiciones, bases legales y evolución histórica, a la vez que se profundiza en su repercusión en el sector salud y se desarrollan (...) las peculiaridades del trabajo anatomopatológico desde sus manifestaciones en la actividad asistencial, docente e investigativa. Se concluye que los principios éticos generales de la conducta profesional y médica son aplicables al trabajo anatomopatológico en todas sus esferas; al igual que los de la bioética. ABSTRACT The objective of the present study is directed to exhibit ethical peculiarities of the anatomical-pathological work in view of the historical-social reality. Theoretical and empirical methods are used and from the documentary analysis it occurs with modality in the contemporary approaches. The study of general aspects referred to the morality and to the ethics allowed to gain access to definitions, legal bases and historical evolution, simultaneously that deepens in its aftereffect in the sector health and the peculiarities of the anatomical-pathological work develop from its declarations in the welfare, teaching and investigative activity. One concludes that the general ethical beginning of the professional and medical conduct is applicable to the anatomical-pathological work in all its spheres; as those of the bioethics. (shrink)

RESUMEN Se fundamenta la concepción teórica general de la educación axiológica en el contexto del sistema de enseñanza de postgrado para la formación de educadores ambientales. Se aplicaron los métodos del nivel teórico analítico-sintético, inductivo-deductivo, histórico-lógico y ascensión de lo abstracto a lo concreto, con la intención de sistematizar información proveniente de la bibliografía consultada y de la experiencia profesional de los autores. Se defiende la idea de considerar la existencia de una dimensión ambiental de valores universales, en lugar de (...) hacer referencia a valores estrictamente ambientales. Se enfatiza en la importancia que, para la educación, adquiere la estimulación de la actividad valorativa del sujeto, a partir de una noción precisa del sistema de virtudes y fortalezas del carácter. Se identifican cinco valores básicos a desarrollar en el educador ambiental, para asegurar, desde el punto de vista axiológico, su desempeño en la preparación de diferentes sectores sociales y consolidar la necesaria contribución de los mismos a la sostenibilidad ecológica. ABSTRACT In this paper a general theoretical conception of axiological education is systematized in the context of the postgraduate educational system in the training of environmental educators. Methods of the theoretic level to systematize information obtained from the bibliography and from the vocational experience of the author. The category value is analyzed aimed at using it unilaterally from the environmental perspective and it is concluded that it is much more objective, from the theoretical point of view, to assume the existence of an environmental dimension of universal values ​​rather than of strictly environmental values. It emphasizes on the importance of the stimulation of the person’s valuating activity for education, from a precise notion of the system of virtues and character strengths. Five basic values are identified ​​ to be developed in an environmental educator to ensure, from the axiological point of view, his performance in the preparation of different social sectors to strengthen their necessary contribution to ecological sustainability. Resumen En este trabajo se estudia la percepción de un grupo de estudiantes universitarios sevillanos, sin conocimientos especializados sobre la variación geográfica y social del español, hacia las variedades andaluza, canaria y castellana. Los resultados revelan la presencia significativa de juicios negativos hacia su propia modalidad de habla, tanto en lo relativo a la pronunciación como a su asociación con un estatus social bajo. No obstante, se produjo un incremento de consideraciones positivas cuando se les pidió la valoración de los (...) habitantes de su región, los andaluces. La variedad castellana, que se identificó como la forma de hablar más prestigiosa, recibió las valoraciones más positivas: fue considerada una pronunciación clara y sus hablantes se asociaron a una posición social elevada. En tercer lugar, las creencias sobre la variedad canaria reforzaron algunos tópicos como la dulzura del acento. (shrink)

El creciente interés que han suscitado los fenómenos psiquiátricos en el ámbito académico ha favorecido el desarrollo de análisis interdisciplinarios que combinan la filosofía con campos como el de la medicina, las neurociencias y las ciencias cognitivas. Un ejemplo de esto es el trabajo de John Campbell quien ha intentado analizar el fenómeno de la inserción de pensamiento y la constitución de la agencia del pensamiento a la luz del modelo de la copia eferente desarrollado por Christopher Frith y otros (...) neurofisiólogos. Inicialmente, dicho modelo fue pensando para dar cuenta de la agencia del movimiento voluntario, por lo que su aplicación en el ámbito de los fenómenos mentales es un desafío. En este texto se busca hacer una crítica del modelo planteado por Campbell, a partir de algunos de los conceptos centrales en la fenomenología de Gallagher y Zahavi y de la psiquiatría de corte fenomenológico. The article examines the compatibility of agonistic democracy and populism as well as their relationship to the idea of constitutionalism. The first part shows that Chantal Mouffe’s recent attempts to reconcile her normative approach of an agonistic pluralism with a populist style of politics are not fully convincing. Although there are undeniable commonalities between an agonistic and a populist understanding of politics – the appreciation of conflict, the rejection of moralistic and juridical modes of conflict resolution etc. – the populist (...) mode of the construction of the people (and the denunciation of political opponents as enemies of the people) risks impeding the transformation of antagonistic into agonistic modes of political contest. The tensions between agonism and populism are especially evident in matters of constitutionalism. This topic is examined in the second part of the article, which provides some ideas for reducing the normative and institutional blind spots of contemporary theories of agonistic democracy. It focuses on elementary principles for an agonistic concept of democratic constitutionalism that differs from the populist view of the relationship between politics and law, especially in respect of its interpretation of the concept of ‘resistibility’ of legal norms. Por ello, es importante asumir una ética del rostro en (...) Merleau-Ponty; así como, del cuerpo en Lévinas. She could just point to a letter board similar to an Ouija board and spell out words and phrases with her right hand and then use her eyes to indicate if we were correct. Mary was a refined woman but very patient with me because I was an 18-year-old boy trying to be a man, sensitive but having a lot to learn. Mary taught me how to communicate without words—just using the eyes.These women are the core of understanding the meaning of what I have done for 30 years. Whether imprisoned by hearing loss, loss of sight or mobility, failing bodies and minds or simply being alone—the challenge was the same, to know when to reach into another's soul and touch them, to stay out of the way, and have the good sense to know the difference. El derecho a descansar es una reivindicación de justicia de primer orden. Es una demanda dirigida al núcleo de la organización social de nuestras necesidades. La caracterización de este derecho se presenta, la mayor de las veces, a partir de los conceptos de trabajo productivo -remunerado- y de cuidado -en gran parte no remunerado. La defensa del ocio y también de la pereza es convocada tanto por los trabajos creativos como por los industriosos. Pero, qué pasa cuando el derecho a (...) descansar no se dirige a cuestionar qué entendemos por trabajo, sino a qué entendemos por actividad y a qué llamamos reposo. ¿Qué ocurre si el derecho a descansar muestra la necesidad de iniciar un proceso de descolonización de nuestros cuerpos? La propuesta de Gloria Anzaldúa, y esto es lo que artículo defiende, consiste en mostrarnos que para poder pensar el descanso y hablar de él, la materia prima está en nuestros cuerpos, en atender a las formas de sujeción colonial que aún los habitan. The literature on the interplay between geographic communities and organizations has largely ignored the role of individual residents. In adopting a meso-perspective, we examine a potentially vital relationship between corporate conduct and pro-social behavior demanding sacrifice from individuals. Drawing on Weber ), we theorize that organizations in a community legitimize personal social conduct in three ways—by serving as role models, imparting norms and values, and routinizing forms of interaction. We study the relationship between corporate social responsibility behavior by local firms (...) and the social distancing of citizens in US counties during the Covid-19 pandemic, a core ethical outcome. We argue and find that the residents of communities in which firms exhibit higher levels of CSR engaged in more SD during the Covid-19 pandemic. This was true when firms were long-established, isomorphic in their CSR, and major employers and vendors. Moreover, CSR relating to the treatment of employees as well as positive and negative extremes in CSR bore especially strong relationships with SD. Implications are drawn for the study of business ethics, as modeled by CSR, as a force for ethical personal behavior and public health in communities. (shrink)

In this paper, the process for firms to decide whether or not to invest in corporate social responsibility is treated from a real option perspective. We extend the Husted framework with an important extra parameter that allows us to understand the timing of CSR investment and explain why some companies drag their feet over CSR investments. Our model explicitly allows for the impact of the opportunity cost of delaying the CSR investment decision, providing firms with tools to determine the optimal (...) moment of exercising the CSR investment option. We illustrate our timing model through a case study and analyze governmental support strategies for CSR from a real options perspective. (shrink)

This paper will be concerned with the conjunctive interpretation of a family of disjunctive constructions. The relevant conjunctive interpretation, sometimes referred to as a “free choice effect,” (FC) is attested when a disjunctive sentence is embedded under an existential modal operator. I will provide evidence that the relevant generalization extends (with some caveats) to all constructions in which a disjunctive sentence appears under the scope of an existential quantifier, as well as to seemingly unrelated constructions in which conjunction appears under (...) the scope of negation and a universal quantifier. This paper endorses the idea that an ethical and political perspective on precariousness would be informed by a social theory. Nancy Fraser’s Critical Theory of Justice is a good sample of this requirement. The aim of her critical account consists in to identify the social contradictions of capitalism to make a proper diagnosis of our current era. The diagnosis is the beginning to analyze the emancipatory options, entangled with those contradictions, to find out the society’s sense of justice. According to (...) that, this paper deals with the recent adjustments in Fraser’s Social Critical Theory of Justice that focuses on the new orders of subjection in our current societies. This paper deals with the main importance of gender perspective in Critical Theory. So, first, it exposes some elements of the exchange between Nancy Fraser and Jürgen Habermas on the social activity of childrearing. Then, N. Fraser’s interpretation of the theory of the crisis of capitalism seen from the crisis of care is presented. These issues would help us to understand the complex and dynamic link between the gender order and capitalism.

Este trabajo busca mostrar la relevancia de considerar el punto de vista de la geografía crítica en relación a la fundamentación normativa de los principios de justicia en el marco de la justicia global. Partiendo de la definición de Escalas de Justicia de N. Fraser considero importante apuntar que un énfasis en la noción de escala geográfica como resultado de la acción social puede ayudar a clarificar el problema del alcance de los principios de justicia. En este sentido la idea (...) guía para pensar la forma de las escalas de dominación consiste en asumir que las formas de interacción social mediadas por normas definen unas determinadas relaciones de poder entre miembros habitantes de un mismo espacio político delimitado por el alcance que suponen las mismas normas. En otras palabras, pensar el espacio de acción social a nivel de las escalas hace posible considerar la forma estructural en virtud de la cual dicho espacio se articula normativamente. (shrink)

We present an argument for revising the theory of alternatives for Scalar Implicatures and for Association with Focus. We argue that in both cases the alternatives are determined in the same way, as a contextual restriction of the focus value of the sentence, which, in turn, is defined in structure-sensitive terms. We provide evidence that contextual restriction is subject to a constraint that prevents it from discriminating between alternatives when they stand in a particular logical relationship with the assertion or (...) the prejacent, a relationship that we refer to as symmetry. Due to this constraint on contextual restriction, discriminating between alternatives in cases of symmetry becomes the task of focus values. This conclusion is incompatible with standard type-theoretic definitions of focus values, motivating our structure-sensitive definition instead. (shrink)

Building on previous works which argued that scalar implicatures can be computed in embedded positions, this paper proposes a constraint on exhaustification which restricts the conditions under which an exhaustivity operator can be licensed. We show that this economy condition allows us to derive a number of generalizations, such as, in particular, the ‘Implicature Focus Generalization’: scalar implicatures can be embedded under a downward-entailing operator only if the scalar term bears pitch accent. The notion of measurement plays a central role in human cognition. We measure people’s height, the weight of physical objects, the length of stretches of time, or the size of various collections of individuals. Measurements of height, weight, and the like are commonly thought of as mappings between objects and dense scales, while measurements of collections of individuals, as implemented for instance in counting, are assumed to involve discrete scales. It is also commonly assumed that natural language makes use of (...) both types of scales and subsequently distinguishes between two types of measurements. This paper argues against the latter assumption. It argues that natural language semantics treats all measurements uniformly as mappings from objects (individuals or collections of individuals) to dense scales, hence the Universal Density of Measurement (UDM). If the arguments are successful, there are a variety of consequences for semantics and pragmatics, and more generally for the place of the linguistic system within an overall architecture of cognition. The article inquires about the role of language in Cristina Peri Rossi’s Panic Signs [Indicios pánicos]. The hypothesis of the work is that language, as a mimetic instrument of representation and creation, established itself as a way to upgrade the relations of power during the Uruguayan pre-dictatorship. Being a qualitative research based on a hermeneutical approach, the article has the following aims: i) reconstruct the background to the dictatorship leaded by Juan Maria Bordaberry, ii) frame the work within the tradition (...) of dictator novel following Lukács’ socio-critical approach and Pierre Bourdieu’s field theory, iii) explain how language works as an instrument of representation and power, iv) analyze Peri Rossi’s work in the light of the aforementioned framework. It concludes, first, that the work responds to a mimetic language of representation, which involves taking a stance that is based on the notions of hegemony or counter-hegemony; and, second, that provided the scarce studies concerning the circumstantial situations of the work, the article might be regarded as a significant contribution to literary criticism. Recently there has been a lively revival of interest in implicatures, particularly scalar implicatures. Building on the resulting literature, our main goal in the present paper is to establish an empirical generalization, namely that SIs can occur systematically and freely in arbitrarily embedded positions. We are not so much concerned with the question whether drawing implicatures is a costly option (in terms of semantic processing, or of some other markedness measure). Nor are we specifically concerned with how implicatures come about (...) (even though, to get going, we will have to make some specific assumptions on this matter). The focus of our discussion is testing the claim of the pervasive embeddability of SIs in just about any context, a claim that remains so far controversial. While our main goal is the establishment of an empirical generalization, if we succeed, a predominant view on the division of labor between semantics and pragmatics will have to be revised. A secondary goal of this paper is to hint at evidence that a revision is needed on independent grounds. But let us first present, in a rather impressionistic way, the reasons why a revision would be required if our main generalization on embedded SIs turns out to be correct. In the tradition stemming from Grice (1989), implicatures are considered a wholly pragmatic phenomenon and SIs are often used as paramount examples. Within such a tradition, 㳊 semantics is taken to deal with the compositional construction of sentence meaning (a term which we are using for now in a loose, non technical way), while pragmatics deals with how sentence meaning is actually put to use (i.e. enriched and possibly modified through reasoning about speakers’ intentions, contextually relevant information, etc.). Simply put, on this view pragmatics takes place at the level of complete utterances and pragmatic enrichments are a root phenomenon (something that happens globally to sentences) rather than a compositional one.. The foundations of analysis offered by Cauchy and Riemann were not immediately welcomed by the mathematical community. Before 1870 the foundations of mathematics were considered more or less a national affair. In this paper, Dutch ideas of rigour in analysis between 1840 and 1870 will be discussed. These ideas show that Dutch mathematicians were aware of developments abroad but preferred the concept of infinitesimals as a foundation of mathematics.

Many contemporary legal positivists have argued that legal theory is evaluative because it requires the theorist to make judgments of importance. At the same time they argue that it is possible to know without resort to evaluative considerations. I distinguish between two senses of : in one sense it refers to legal validity, in another to the content of legal norms, and I argue that legal positivism is best understood (as indeed some legal positivists have explicitly said) as a claim (...) about legal content. Understood this way, however, it is open to the objection that knowing the content of legal norms requires evaluative considerations for reasons similar to those offered by positivists for thinking that legal theory is requires evaluative considerations. Background The expressions of a “wish to hasten death” or “wish to die” raise ethical concerns and challenges. These expressions are related to ethical principles intertwined within the field of medical ethics, particularly in end-of-life care. Although some reviews were conducted about this topic, none of them provides an in-depth analysis of the meanings behind the “wish to hasten death/die” based specifically on the ethical principles of autonomy, dignity, and vulnerability. The aim of this review is to understand if and (...) how the meanings behind the “wish to hasten death/die” relate to and are interpreted in light of ethical principles in palliative care. Methods We conducted a meta-ethnographic review according to the PRISMA guidelines and aligned with Noblit and Hare’s framework. Searches were performed in three databases, Web of Science, PubMed, CINAHL, with no time restrictions. Original qualitative studies exploring the meanings given by patients, family caregivers and healthcare professionals in any context of palliative and end-of-life care were included. A narrative synthesis was undertaken. PROSPERO registration CRD42023360330. Results Out of 893 retrieved articles, 26 were included in the analysis, accounting for the meanings of a total of 2,398 participants. Several factors and meanings associated with the “wish to hasten death” and/or “wish to die” were identified and are mainly of a psychosocial and spiritual nature. The ethical principles of autonomy and dignity were the ones mostly associated with the “wish to hasten death”. Ethical principles were essentially inferred from the content of included articles, although not explicitly stated as bioethical principles. Conclusions This meta-ethnographic review shows a reduced number of qualitative studies on the “wish to hasten death” and/or “wish to die” explicitly stating ethical principles. This suggests a lack of bioethical reflection and reasoning in the empirical end-of-life literature and a lack of embedded ethics in clinical practice. There is a need for healthcare professionals to address these topics compassionately and ethically, taking into account the unique perspectives of patients and family members. More qualitative studies on the meanings behind a wish to hasten death, their ethical contours, ethical reasoning, and implications for clinical practice are needed. (shrink)
